Assignment: Using information presented in the library research instruction session, find and evaluate TWO resources on the topic ofIntellectual Property from library database subscription journal sources (Academic Search Premier, ERIC (Ebsco), WorldCat, or Proquest, for example). The assignment will sharpen your ability to critically evaluate peer-reviewed research sources, and serve as a springboard for Essay #2. You must explain the credibility and relevance for EACH source. For credibility, explain in 100-150 words why this is an academically sound (credible) source. You can discuss the author, the publication, the affiliated institution, the support in the source itself. For relevance, explain in 100-150 words or more how the content of the source connects to the topic. Ideally, these two sources would serve as your sources for Essay #2.

These authors are authorities in their respective fields. Shaw is a M.D. candidate at Harvard University with degrees from Oxford University. Warsh is a Ph.D. candidate from Oxford and holds degrees from the London School of Economics. Kesselheim is Asst. Professor of Medicine at Harvard Medical School and works at Brigham and Women’s Hospital in London. The publication appears in the Journal of Law, Medicine, and Ethics, and is a recent publication from Winter of 2013. These individuals represent a significantsample from the medical world in globally diverse developed countries, and would need to know about legal issues involving intellectual properties in order to protect their practices.

Shaw, Warsh, and Kesselheim take up the intellectual property question of sharing medicine ideas across international borders. This is a highly polarized issue because many feel that intellectual property rights should apply, and ideas not be shared. Shaw et. al, look to the legislation established by WTO and developed countries in TRIPS (Trade-Related Aspects of Intellectual Property Rights), and promote the premises of natural right and utilitarianism in an attempt to squelch what they consider to be unreasonable demands that medicines cannot be reproduced due to intellectual property laws. They argue that the sharing of new medicines is essential across the globe. Controversies abound, and Shaw, Warsh, and Kesselheim’s views supports my own, that owners of intellectual property rights own the creation, but that the creation in whatever form should be able to be reproduced without being constrained by selfish motives. An inventor maintains the ownership of the idea; however, when the idea is a benefit to mankind, others should be allowed to partake of it, copy it, expand upon it, and share it, without fear of recrimination.
